A demand letter attorney for the Bronx.

Flat-fee attorney demand letters for Bronx County disputes, sent by certified mail from a Manhattan-based New York law firm.

The Bronx has the city's highest share of renters and a dense economy of small contractors, auto shops, home-care agencies, and family-run stores. Its money disputes follow: repairs a landlord will not make, deposits that do not come back, final paychecks that never arrive, and invoices between small businesses. This page explains the Bronx County forum, which claims are worth pursuing, and how a flat-fee letter works without coming to an office.

NYC CCA § 1801 · $10,000 SMALL CLAIMS

The forum for a Bronx dispute.

A Bronx money claim that becomes a lawsuit is usually filed in the Small Claims Part of the Civil Court of the City of New York, Bronx County, which hears claims up to $10,000 under the New York City Civil Court Act. No lawyer is needed, there are evening sessions, and the court is used to tenants, workers, and small-business owners presenting their own cases. Claims above $10,000 go to the regular civil part or to Bronx County Supreme Court. Housing disputes with a landlord are handled by Bronx Housing Court, which is a separate part with its own procedures.

The demand letter works because the filing is credible. A letter that describes the claim and names Bronx County Civil Court as the next step tells the other side that you know the process and can afford it. See our NYC small claims court guide and the broader New York small claims court guide.

Bronx disputes we see most.

  • Landlords who will not make repairs. The Bronx has the largest concentration of rent-stabilized and older multi-family buildings in the city, and the heat, hot water, leak, and mold complaints to match. Tenants know about 311 and HPD. Fewer know that a written demand citing the warranty of habitability creates the record for a rent abatement and often gets a landlord's attention faster than an inspection request, because it signals a tenant who is organized. Start at landlord won't make repairs.
  • Security deposits. Moving out of a Bronx apartment and never seeing the deposit again is routine. General Obligations Law § 7-108 requires the landlord to return the deposit, with an itemized statement of any deductions, within 14 days. A landlord who misses that deadline is in a weak position, and a letter that says so tends to produce a check.
  • Final paychecks and unpaid wages. Home health aides, restaurant staff, construction laborers, and security guards in the Bronx regularly come to us over a final check that never came or weeks of work paid short. New York's Labor Law protects those wages regardless of immigration status, and a demand letter that names the Department of Labor complaint and the penalties as the next step is usually taken seriously.
  • Auto repair and contractor disputes. The Bronx has a heavy concentration of auto body and mechanic shops, along with small contractors working on the borough's one- and two-family houses in Throgs Neck, Morris Park, Wakefield, and Riverdale. Repairs paid for and not done, or deposits taken on a job that never started, are contract claims. See contractor took my deposit.

Small businesses in the Bronx.

Bronx businesses, from Hunts Point distributors to bodegas and salons on Fordham Road and the Grand Concourse, carry receivables from customers who stop paying. Commercial small claims in Bronx County Civil Court is available for businesses, and a demand letter itemizing the invoices with a single deadline is the right first step. See unpaid invoices for small businesses. Bronx freelancers, including the borough's growing film and music production scene, are covered by the city's Freelance Isn't Free Act; read New York Freelance Isn't Free Act.

How the flat-fee letter works for a Bronx address.

Hochman Law PC is a Manhattan-based firm that serves the Bronx and all of New York State remotely through DemandLetterNY.com. You complete an online intake and upload what you have: the lease, photos of the conditions, pay stubs or schedules, texts, invoices, receipts, the contractor's estimate. An attorney reviews it and drafts the letter. It is sent by certified mail with return receipt to the landlord's, employer's, or business's address, with an email copy where possible, and you get a copy of the full package. No office visit, no time off work. Details at flat-fee demand letters.

For landlord letters, we send to the address on the lease and, where different, to the managing agent or owner listed with HPD, so there is no argument about who received it.

What the letter does in a Bronx dispute.

A demand letter from a New York attorney gives a Bronx landlord, employer, or contractor a specific problem to solve by a specific date. It identifies the law that applies, states the amount, attaches the evidence, and names the court or agency where the claim goes next. It also offers the exit: pay, or propose a written plan. For a small landlord who has been ignoring a tenant, or a shop owner who has been ignoring a former employee, the arrival of a certified letter from a law firm is frequently the moment the calculation changes.

Is it worth a letter? A Bronx example.

A tenant leaves a Kingsbridge apartment clean, with photos, and the landlord keeps the $2,400 deposit without sending any itemization. Fourteen days pass. That is a strong claim: the statute sets the deadline, the photos document the condition, and the landlord owns a building and can pay. A flat-fee letter is a small fraction of $2,400 and, in our experience, a landlord who has to explain to a judge why no itemization was ever sent usually decides to send a check instead. Worth it.

A $150 dispute with a former roommate who has moved out of state with no forwarding address is a different calculation. We will say so. See demand letter vs. small claims.

Loans and deposits between people.

Personal loans to relatives and co-workers, a party hall or caterer that kept a deposit, a mover who held furniture for extra cash: all of these are contract claims that a letter can address. Start with lent money, not paid back and vendor kept my deposit.

Timing.

Contract claims have a six-year limitations period under CPLR § 213(2). Security deposit, wage, and habitability claims each have their own clocks and, more importantly, their own evidence that fades. Photos taken today and a letter sent this month are worth more than either will be next year.
